December 7 marks the end of so-called Zombie Agreements after a protracted sunset period.
The term Zombie Agreement covers various registered employment agreements made before 1 January 2010 that continued to operate when the Fair Work Act 2009 came into effect.
They include certified agreements, collective agreements, Australian Workplace Agreements (AWAs), and Individual Transitional Employment Agreements (ITEAs) made under previous Commonwealth law.
This also extends to, collective and individual agreements that were registered under some state industrial relations laws, and enterprise agreements made by the Fair Work Commission in the “bridging period” between 1 July 2009 and 31 December 2009.
